Spouse 's Resident permit

Question

Dear members,

I am a Belgian citizen and my wife (non-EU) having residence card as my dependant. Currently I got a job in Germany and thinking of relocating alone while my wife stays in Belgium. I am keeping our Belgian address, insurance coverages for both. Can she obtain a Belgian residence permit based on my status? Her permit expired and 1 month passed still no positive status on her application.

If you have no job in Belgium and have no incomes to show then she may have troubles. You should show continuity of income plus other docs to be approved. If you wish to be processed faster then apply via the embassy of her residence country. Do not start via commune. But you must show income inBelgium.

What is your spouse's current and past status in Belgium?
What is your current residence status in Belgium?
When did you start working in Germany?
Do you have any children?

Normally spouse of EU citizen application takes 6 months exactly. They will assess the case probably towards the end of the 6 months so no use waiting for an answer in the initial months.

@SHORTOF: we lived together since April 2016 and her status remains non working housewife. I started working this month(May) and regularly visiting Belgium to see my family. We have a newborn(Belgian by birth). Can my case be considered as cross-border commuter?

@CRISSCROSS: Isn't it risky to wait up to 6 months without the Residence permit?
