Problem get passport from the embassy

Question

Good day everyone, please l need help. my wife and I are Belgian by nationality but born in Nigeria, we just had a baby here in the UK, we are both student here in the UK for 4 year now. l have called the belgium embassy but l was told it will take few years for the document to come through.
l also called the Home-Office, l was told because l don't have premier insurance when l came into the country my child is not entitled to passport.

Please what is the quickest way to get my baby a passport Belgian or Uk Passport. Thanks for your help.

Your only option is the Belgian embassy.

Belgian citizenship is acquired by:

One was born abroad and the Belgian parent was born abroad and makes a declaration, within a period of five years following the child's birth, requesting that he be granted Belgian nationality. This declaration (declaration d'attribution/toekenningsverklaring) must be submitted to the Belgian embassy or consulate in the main place of residence of the Belgian parent abroad, or the registrar in the parent's municipality (if the parent lives in Belgium). Belgian nationality is obtained on the date upon which the declaration is made.

Nothing to do with insurance. You should have registered with home office 4 years ago, because you failed to do so and cannot prove your Starr date of residence in retrospect, you cannot register your child as British and must now wait till you ve satisfied residence rules then finally your child can register as British.

Thanks J: do you know how long the process will take? as l currently met a woman from Belgium going through the same issue. she told us when she sent the birth certificate to the Belgium embassy, the embassy replied with reason why they wouldn't give her child passport. Thanks

Being born in the UK doesnt grant a person the right to nationality or a passport. Why do you think ypur child is entittled? They are in the USA its different but UK they want to know the nationality of the patents and grand patents too before they allow the right to be British. We had a child in Belgium and we went to the British embassy to register his birth and then we could apply for a British passport for him because he isn't Belgian but British. As youre Belgian there was no need to register you arrival in the UK foramlly so ignore that comment above but the best thing to do is speak to the Belgian embassy about getting your child a Belgian birth certificate and then apply for a pass port for them all the best

Also you may get some issue with health bills if you're in the UK you should be covered normally for a short visit but im not sure about prolonged stay do you have a mutelle here? Some ateas in the UK are proactive seeking cost for treatment and child birth i imagine involved doctors midwives and probrably hopsitals I would also ask the embassy advice on that

Concerning the answers about health insurance, I wonder whether posters are aware of the fact that "students and other categories of EU nationals including stay-at-home parents" are subject to a "hitherto little-known requirement to have comprehensive sickness insurance (CSI) to qualify for residency in the UK". Having access to the NHS does not qualify. It's all a little confusing but UK nationals should be aware that EU students have a special status in the UK that does not qualify for permanent residence. It's been like this for decades.

The child born in the UK is actually entitled to register as British once the residency conditions are fulfilled so the op is right. It s my job to know and deal with this. However the op pointed out they have not fulfilled residency conditions yet for child to register as British.

And you're wrong, registering as an EU national in UK though not obligatory is pretty useful, as proved by op not doing it 4 years ago, now unable to backdate it, clock starts tucking for residency when they fulfilled the conditions.
