Question

HI all,
Anyone who may have an idea about what my friend should do.
This friend of mine has got a baby with a lady who has over stay her visa.
My friend is not yet a Belgian national so it does make things a bit complicated.
he only got F+ and has a job . The baby is just a month and half old.
But last week a letter came in from the commune for the lady to go to the commune. when she got to the commune ,she was given a paper to sign to leave the country. but this guy can not afford to loose this lady because of the little baby.
Does any of you have an idea what can be their options to get this lady to stay in Belgium to take care of her baby.
the couple are now living on the same address but the commune has refuse to register the lady officially on the address of the man. but the child is now registered under his father.

Well, there are only two choices: She leaves the country as she was directed to do with or without the child. She cannot stay here. She has broken the law by staying past her visa time and no one is going to help this woman I am afraid. The situation is unfortunate, but how can anyone help or be compassionate with someone who deliberately does these things? Your friend isn't even Belgian, so that makes matters even worse. These kinds of situations are what make it difficult for people who have come to Belgium and are law-abiding. Can't give you any suggestions on how someone can stay in the country who was told to leave. My suggestion again is that she should sign the paper and leave before she gets forced out and if she is living in Flanders it won't take much time for that to happen. Sorry to be so blunt, but this is the truth. They aren't going to allow her to stay because your friend, the non-Belgian, needs her here for the sake of the baby and/or for himself. That's not how the system works.

F+ implies your friend is a non-EU citizen.

Option 1: Get married. (This would be the complicated thing to do)
Option 2: Leave the country with the child and its mother. (this would be the decent thing to do)

The important think for your friend to apply for nationality. As he has F+ I think he fulfills the requirements for Belgian nationality. I suggest the lady to stay even that it is staying illegally so they live together with the baby. Once he receives Belgian nationality he may apply asap for marriage so she can stay legally through marriage. I would suggest in any case do not leave the country as there will almost impossible for her to get a re entry visa because once she leave they will ban her to enter Europe for at least 5 years.
Another option not ethically correct but works in this case is: In order not to get forcibly deported she has the right to appeal the deportation order in order to allow time in bureaucratic courts for him to receive nationality or she applies for political asylum which means she can stay while her asylum application is being observed and get married at the commune after.

One more time if you want her to stay don't make the mistake to sent back. Do not listen what regulations say. Even if they promise a visa they will never issue it. I have heard lots of horrible stories with immigration and no mater how you entered or how you stayed they cannot never sent back if she marry a Belgian/EU citizen

The f card of friend is granted on what grounds? He s a dependent of an EU national but has got acsny by s non EU national illegal overstayer,,? Your friend needs to look at his status too.

Political asylum what reason? People fleeing persecution and matching in defined refugee status claim asylum at earliest opportunity not as last resort as law breakers who are morally doubtful using the goodwill of a country

I would suggest your friend asks an expert in immigration law for help because no one here can understand the whole of this without more information. I'm not sure of any organisations who can help but imagine there exist some who deal with illegal immigrants which sadly this lady is now

Obtain citizenship? Do you think they just give it to you as soon as you ask for it? He could be waiting years for that. He's got an F+ card and that doesn't grant an easy road to citizenship. Meanwhile, is it ok for this woman to go underground so not to get caught? No, it isn't. She is illegal and no one will be able to help her at this point. She can seek the help of a lawyer, but I sincerely doubt if he/she can help her. God help her if she is asked for an id or papers. They will take her in immediately. They are getting serious and cracking down on these situations. She would just look ridiculous trying to take the asylum seeking route. I get miffed when people do things like this. Why do folks break the law and expect exceptions be made for their situation? It's not fair to the people who are abiding by the law. She should leave as asked. This guy, your friend, and this woman should not try to take advantage of the system. To make matters worse there is a poor baby involved in this mess. I say she should turn herself in and go back and if she is banned for 5 years, etc. then so be it.

Quite cruel answers! Oh she gave birth and used the health system! Like this one and man European countries never colonised any place and used their resources and many still using them! Oh, what a terrible thing, she used the healthcare! What a terrible thing she did! When it comes to immigration, most people's worst sides come out. It is very sad
