Bringing my partner in Belgium

Question

Hey guys,

I am an EU national myself and I will come to do my Master degree in Brussels in September.

I want to bring with me my non-EU partner and live together in Brussels. We have been together for 2 years, but we are not married. My partner has a tourist Shenghen Visa that will enable him to travel to Belgium, but it will expire after some time.

Does anyone know what we should do so that my partner can legally reside with me in Belgium once I am there?

Get information from your commune - you can sign a cohabitation agreement, which is less constraining than getting married, I think. Speak to a notary.

Cohabitation légale isn't actually getting married, but it's pretty close. A cohabitation can be ended easier than a marriage. However, financially, cohabitation is exactly the same as marriage, the cohabitants must file a joint tax return, both are responsible for each others debts, and both have certain entitlements to each others property in the case of death.

Thank you all. But the issue is not so much which option would be less constraining in terms of taxation, debts and so on. At the moment, we are looking for something that will enable my partner to become a legal resident in Belgium once I come there.

From what I have read so far, marriage by itself will not automatically turn my partner into a legal resident. What is needed is a separate procedure called family reunification. Being already married would probably make it easier when applying for family reunification, but even proof of a stable and continuous 2-year relationship would be sufficient.

What is your partner's nationality? I am an Indian married to a Belgian. I came through family reunion visa. Although we were married, my visa got rejected.I can explain how I got through if your partner is Indian.

Op your question has been answered, go maison communale, sign cohabitation, prove how long together, as for EU family reunion. If successful after the 5 months probation, the non EU gets an f card.

Just follow this advice, I m basically repeating the advice given n above.

Everyone has different scenarios so unless they are living in the same commune, earn Same salary, live in same type apartment, it s not going to be relevant.

Go register at the Maison communale with all the relevant paperwork in order for EEA family member.

My marriage was in India. Marriage certificate has been apostilled so it was accepted in Belgium.Since your partner has Schengen visa already I guess it will be not as complicated as mine to enter the country.Maybe you know already https://dofi.ibz.be/sites/dvzoe/EN/Pages/home.aspx , this is the website of Belgium immigration, you can have a look. You can also call or email them if you have more questions.
As one of the comments mentioned about town hall, I am not really sure about it in this case. In my case, I had to register with them within the eight days. I received Belgium F card within a month.
I wish I could help you more, unfortunately, my situation is totally different. It was very difficult for me and my husband because getting a valid visa is a tiring and more time-consuming process. Luckily your boyfriend has Schengen visa hopefully will go much smoother. I wish you good luck!
